Terms and conditions

Article 1. Definitions

‘LIVE-TO-EXPRESS’ means in these general Terms and Conditions eenmanszaak. The firm is registered with VAT BE0730.570.544  in Belgium. LIVE-TO-EXPRESS.com is an online shop and has no physical store. Orders can only be placed online and received by post.

Customer means in these Terms and Conditions every visitor of the website (natural or legal) who places an order at LIVE-TO-EXPRESS.com

Article 2. Application

2.1 The Terms and Conditions apply to all orders placed at the e-shop at www.LIVE-TO-EXPRESS.com.

2.2 By placing an order the customer accepts the application of the General Terms and Conditions.

2.3 Only with an agreement in written, deviation is possible from the General Terms and Conditions, in which case the remaining articles of these General Terms and conditions.

2.4 Only LIVE-TO-EXPRESS maintains the right to adjust these General Terms and Conditions

Article 3. Agreement

3.1 When the customer accepts the offer on the website, an agreement is established.  After the acceptation an order confirmation is sent to the e-mail address given by the customer.

3.2 LIVE-TO-EXPRESS has the right to refuse orders or to ask for additional information. If an order is not accepted, this will be reported to the customer.

Article 4. Personal data

4.1 The date given by the customer will be treated with confidence and only be used for: processing the order and payment and delivery to the correct delivery address.

Article 5. Offer

5.1 LIVE-TO-EXPRESS can’t guarantee that the information given by photos and information are fully in line with the delivered products. Deviations between the products and the given information are no motive for compensation and/or an ending of the agreement. If the product completely differs from the information given on the website, LIVE-TO-EXPRESS will look at the case and if necessary find a solution to satisfy the customer.

5.2 LIVE-TO-EXPRESS can’t be kept to her offer if the customer, in terms of
reasonableness of social understanding, could have understood that the offer contains an obvious mistake or miswriting.

5.3 LIVE-TO-EXPRESS sells used items, so the customer must understand that the products are not in new conditions.

Article 6. Prices and Payments

6.1 All selling prices given by LIVE-TO-EXPRESS are in euro and VAT excluded. The costs of shipping are not included in the selling price.

6.2 LIVE-TO-EXPRESS has the authorization to change prices.

6.3 Special offers are only valid for the period mentioned on the website related to that special offer.

Article 7. Shipping

7.1 LIVE-TO-EXPRESS makes use of the shipping service of Bpost.

7.2 Shipping to an address in within Belgium costs € 4,-, the EU € 5,- and other countries € 6,- or higher. LIVE-TO-EXPRESS has the authorisation to adjust these prices according Bpost’s changes.

Article 8. Delivery

8.1 When the order payment or in advance payment is received before 3 PM (on workdays), LIVE-TO-EXPRESS strives to ship the orders on the same day. The customer will receive the order between 1-15 working days. The given delivery time is an indication. Exceeding the period doesn’t’ give the customer the right for compensation or ending the agreement.

8.2 LIVE-TO-EXPRESS delivers the product(s) on the address given by the customer.

Article 9. Ownership

9.1 The ordered products change their owner during the moment of the delivery at the delivery address. LIVE-TO-EXPRESS is not responsible for damages that arise after the delivery.

Article 10. Return of Items

10.1 For hygiene reasons pierced jewellery cannot be returned or exchanged. It is only allowed to return clip-on earrings. It is possible to return clip-on earrings within 14 days. In order to do this, please notify us via e-mail directly after receiving your order.

10.2 The item that is returned has to be in its original state and in an unworn condition. This means without any smell of perfume, perspiration or cigarette smoke or any other signs of wearing. Returned items that can’t be sold anymore to our opinion, will not be accepted. LIVE-TO-EXPRESS has the right to reject the returned orders or to charge a fee for repair because of the damage of the item.

10.3 The orders has to be returned immediately after the e-mail sent by the customer in which the customer has informed LIVE-TO-EXPRESS of the return. This must be done at latest within 14 business days.

10.4 LIVE-TO-EXPRESS is not responsible for the lost of return orders. The customer has to make sure that the return order is packed and shipped properly.

10.5 It is the customer’s responsibility that the order is sufficiently stamped. Return orders that are not sufficiently stamped will be rejected at all times.

Article 12. Force majeure

12.1 If one or both parties are not able to fulfill their obligation as a result of a circumstance for which one cannot be blamed, force majeure, none of the parties will be hold liable.

12.2 Both parties have the possibility as long as the force majeure lasts to postpone the agreement. If this period takes longer then 2 months, both parties are entitled to end the agreement without any obligation for compensation to the other party.

Article 14. Governing law

14.1 All rights, obligations, offers, orders and agreements, to which these Terms and Conditions apply, as well as these Terms and Conditions, are exclusively governed by Dutch law.

14.2 Of course it can happen that you are not totally satisfied about our products or services. In that case, please contact us as soon as possible, preferably per e-mail:

14.3 Disputes between parties can be submitted to the competent court in the Netherlands.
